1. Introduction
Greetings from SoftPaperLeaf ("we," "us," or "our"). These Terms & Conditions ("Terms") set the guidelines for the use of our yacht charter services and website at softpaperleaf.sbs, managed by SoftPaperLeaf.
By engaging in a charter reservation or using our Service, you consent to these Terms. If you do not agree with any section of these terms, you should not use the Service.
2. Service Overview
SoftPaperLeaf offers luxury yacht charter services, which include:
- Yacht rentals for the day
- Evening yacht tours
- Company team-building outings
- Exclusive gatherings
- Extended yacht voyages
We provide our services subject to availability and prevailing weather conditions. We retain the right to change or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To schedule a charter, you need to:
- Be of at least 18 years old
- Provide valid and comprehensive details
- Make a payment of the requested deposit as noted in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking becomes official only after we receive your payment and you receive our written confirmation. We have full discretion to decline services to anyone.
3.3 Availability
All charters depend on vessel availability and appropriate weather conditions. We strive to accommodate your preferred scheduling wherever possible.
4. Payment Terms
4.1 Pricing
All of our prices are quoted in € and are inclusive of applicable taxes, unless stated otherwise. Prices may be subject to changes without prior notification.
4.2 Payment Schedule
- Initial Deposit: 50% of the full charter cost due during booking
- Remaining Balance: To be paid 48 hours before the charter sets sail
- Supplementary charges (if applicable): To be settled upon the charter's conclusion
4.3 Payment Methods
We accept several forms of payment, including major credit cards, wire transfers, and certified cheques. All payment processing is conducted via secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours prior to departure: Full amount returned minus processing fees
- For cancellations 24-72 hours prior to departure: 50% of the amount is refunded
- Cancellations less than 24 hours before departure: No refund provided
5.2 Weather Cancellations
Should weather conditions not be safe as per our captain's judgment, we will propose either:
- Rescheduling to another available date at no extra charge
- An entire refund should rescheduling not be an option
5.3 Mechanical Issues
Should there be mechanical failures with the designated vessel, we will endeavor to arrange a comparable replacement. If no alternative is procurable, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Every guest must:
- Heed all commands from the crew
- Dress in provided safety gear when required
- Declare any medical conditions that could impinge upon their safety
- Stay within specified areas on the yacht
6.2 Prohibited Items
The following items are not allowed on board:
- Containers made of glass
- Unlawful substances
- Weapons or firearms
- Excessive non-alcoholic beverages (surpassing modest consumption)
- Animals (except if prior authorization has been given)
6.3 Conduct
Passengers should act respectfully at all times. Charter service may be terminated earlier than planned without a refund if a passenger's conduct is deemed a safety hazard or disturbing to others.
7. Liability and Insurance
7.1 Our Liability
We are only liable up to the cost paid for the charter. We are not liable for:
- Personal injuries arising from passenger neglect
- The theft or destruction of personal belongings
- Indirect, collateral, or punitive losses
- Delays stemming from weather or factors beyond our influence
7.2 Insurance Coverage
We possess comprehensive marine insurance that covers our fleet and operations. It is your responsibility to arrange for personal and travel insurance.
7.3 Assumption of Risk
By partaking in our charter services, you acknowledge and own up to the inherent risks involved in such marine activities and take responsibility for personal safety and wellness.
8. Modifications and Itinerary Changes
We reserve the right to alter itineraries, routes, or schedules due to weather conditions, safety concerns, or operational requirements. We will attempt to offer equivalent alternative options whenever possible.
9. Force Majeure
We are not accountable for disruptions, cancellations, or changes due to events beyond our control, including but not limited to:
- Extreme weather occurrences
- Natural disasters
- Governmental edicts
- Port shutdowns
- Vehicular malfunctions
10. Privacy and Data Protection
Your personal details are managed in concordance with our Privacy Policy. Employing our services indicates your approval of the collection and use of your data as outlined in our Privacy Policy.
11. Intellectual Property
Elements found on our website, such as text, images, logos, and graphics are under copyright and trademark law protection. Unauthorized reproduction, distribution, or derivative work creation is forbidden without our express written consent.
12. Governing Law
The laws of Monaco dictate these Terms. Any disputes will be deliberated in the courts of Monaco, Monaco.
13. Changes to Terms
We hold the right to adjust these Terms as deemed necessary. Alterations will be shown on our website and tagged with a new revision date. Ongoing use of our services equates to an acceptance of the revised terms.
